# The digital omnibus package

[00:00] Hello everybody. I'm happy that you are
[00:04] here and want to listen to me. Um um it
[00:08] my lecture concerns the question what is
[00:12] 7? It's an initiative of the European
[00:16] Commission to form all data laws in
[00:20] Europe.
[00:22] Um let me use my PowerPoint slide for
[00:27] that which I have prepared.
[00:37] So
[00:39] the problem as I said is the EU data
[00:43] regulation on data act, AI act and last
[00:47] of course the digital omnibus. Um let me
[00:51] give you first an overview.
[00:55] Um the digital regulatory ecosystem
[01:00] comprises several regulations.
[01:03] On the one hand the data [clears throat]
[01:05] act has to do with the access of the
[01:08] user to data stored for instance in an
[01:12] electronic car.
[01:15] Then the AI act, a huge regulation
[01:19] [snorts] on every problem of AI from a
[01:23] regulatory perspective.
[01:26] And then we have finally the big
[01:28] surprise of Miss Fonderline,
[01:32] the head of the European Commission,
[01:35] the digital on package foreseen for the
[01:40] end of this year and the beginning of
[01:43] next year. The aim is to have a coherent
[01:47] governance of data and AI.
[01:50] Um
[01:52] let me first talk about the data act
[01:55] which ended in 4th of the 11th of
[01:57] January 2024.
[02:00] Um the objective is a fair access to
[02:04] data generated by connected devices such
[02:08] as um automatic cars or um um electronic
[02:14] refrigerator.
[02:16] Key element is for especially the user
[02:19] rights to access of data uh from
[02:24] information and technology devices.
[02:28] Um and in addition there are data
[02:30] sharing obligations for data holders.
[02:35] We have design obligations for these
[02:38] devices. Device must enable user access
[02:41] by default. And um problem is how does
[02:47] it uh can be regulated without any
[02:51] interference with the general data
[02:54] protection regulation and sectoral laws.
[02:58] Then we have the EOX
[03:02] which entered into force at the in
[03:05] August 2024.
[03:08] It has a riskbased approach. Um it
[03:12] distinguishes
[03:13] certain
[03:15] risks. Um when you use AI, we have
[03:19] prohibited a AI users for instance for
[03:24] manipulative
[03:25] predictive policing. We have um
[03:29] high-risk systems. There's a huge volume
[03:33] of regulations on these highrisk
[03:36] systems.
[03:38] So they have conformity assessment
[03:39] documentation. They have human oversight
[03:43] and in the last minute they have
[03:46] integrated
[03:48] additional regulations on um general
[03:51] purpose AI such as shared GBT [snorts]
[03:55] um or deepseek
[03:57] means they have to fulfill transparency
[04:01] duties all the functions um very highly
[04:07] um so you have to really stick to these
[04:10] rules
[04:12] The problem is the data act and the AI
[04:15] act have been made without um reference
[04:18] to each other. So they are independent
[04:22] and um there are lot of overlaps
[04:26] um and they threaten at least in the
[04:29] view of the commission to kill new
[04:32] applications for instance in AI
[04:37] overlaps are especially the exercise
[04:40] right for the data act do not fit um
[04:45] with the documentation duties in the AI
[04:48] act.
[04:49] So there are a lot of challenges and
[04:53] threats for AI companies.
[04:57] That is the reason why Miss Fonder made
[05:00] the digital omnimous package 2025
[05:05] started um the first official draft will
[05:09] be published at the end of November.
[05:13] Um we know several parts of these um
[05:16] package.
[05:18] So is the idea to simplify digital
[05:21] regulation. [snorts] Um therefore it
[05:24] covers GDPR, data act, AI act, data
[05:29] governance act, open data directive. All
[05:31] these regulations are
[05:34] put together for a new omnibus package.
[05:40] Is the aim on to reduce the burdens
[05:43] especially for small and medium
[05:45] enterprises
[05:47] and to clarify all these overlaps
[05:50] between acts and directives which have
[05:53] been enacted um um so far
[05:58] and there's a aim to extend compliance
[06:02] deadlines
[06:05] so not to kill all um new initiative
[06:09] atives technology
[06:11] um from the side of legislator.
[06:17] So and the commission needs to solve the
[06:20] following questions. How does will data
[06:23] act ask exercise affect AI training
[06:27] obligations?
[06:28] Will the omnibus lead to a substantive
[06:32] AI act amendment and liberalization?
[06:36] Um,
[06:38] are small and medium enterprises
[06:40] sufficiently protected from regulatory
[06:43] overload?
[06:44] And how do data ex design obligations
[06:49] shamed in information and technology
[06:53] systems and AI?
[06:56] That is all I can say within my
[07:00] 10 minutes for scene. I hope you've
[07:02] understood.
[07:04] There will be a followup video which I
[07:09] recommend very highly when the first
[07:13] draft will be published. I stick to the
[07:16] point and um report on that in the
[07:20] video.
